Terms of Use

These terms govern access to Elbert County Criminal History. Visiting a page, reading its content, or submitting a query through a search tool signifies acceptance of these conditions. Anyone who does not agree should stop using the website.

NO FCRA USE. Elbert County Criminal History is privately operated and has no connection to a local, state, or federal government body. Neither the website nor its advertising partners offers a service intended for credit, employment, insurance, tenant, or other decisions regulated by the Fair Credit Reporting Act (FCRA). Its purpose is to help readers locate criminal-record resources in Elbert County, Georgia. It is not a private investigation firm or consumer reporting agency.

1. What This Website Is

This is a private reference site, independent of every government office. It does not store official criminal records, retrieve records for a visitor, conduct official background checks, or file documents.

The content identifies custodians such as the Elbert County Sheriff's Office, Elbert County courts, the Georgia Bureau of Investigation's Georgia Crime Information Center (GCIC), and the Georgia Sex Offender Registry. Public-agency access is governed by laws that include the Georgia Open Records Act, O.C.G.A. §§ 50-18-70 through 50-18-77, and GCIC dissemination provisions in O.C.G.A. §§ 35-3-34 and 35-3-35. 3. No Harassment, Stalking, or Discrimination

Information found here or through a linked tool must not be used to harass, stalk, intimidate, threaten, or discriminate against anyone. Such conduct is prohibited and may be criminal. Georgia's registry framework, including O.C.G.A. § 42-1-12, restricts misuse of Georgia Sex Offender Registry data. The registry supports public safety awareness, not vigilantism, blacklisting, or unlawful discrimination.

4. We Are Not a Consumer Reporting Agency

Elbert County Criminal History is not a consumer reporting agency under the FCRA and does not create background checks, credit reports, or consumer reports. Its advertising partners are not presented as services for evaluating applicants, insurance risk, or credit. You must not use material from the website or a linked tool to:

  • Make a hiring or termination decision
  • Evaluate a renter or housing applicant
  • Assess credit or establish an insurance premium
  • Determine eligibility for a license, permit, or public program
  • Carry out any other decision regulated by the FCRA

A legally required check for a regulated purpose must be obtained through an authorized Georgia Bureau of Investigation or GCIC process, or from a provider that complies with the FCRA.

5. No Legal Advice

Website content is not legal advice. General information about Elbert County records cannot determine how a charge, conviction, warrant, record restriction, or court sealing rule applies to a specific matter. Consult a lawyer licensed in Georgia for that advice.

6. No Warranties

All content and services are provided "as is." No warranty is made that:

  • Information will always be accurate, complete, or current

Elbert County Criminal History is not responsible for their content, privacy practices, charges, or availability. Review each destination's terms before using it.

8. Intellectual Property

Text, graphics, logos, and code are owned by Elbert County Criminal History or its content partners. They may not be copied, distributed, modified, or used to create derivative work without prior written permission.

9. Limits on Our Liability

To the maximum extent allowed by law, Elbert County Criminal History is not liable for damages arising from use of the website, including reliance on content or a linked service.

10. Indemnification

You agree to defend and hold Elbert County Criminal History harmless from claims, demands, or proceedings caused by your use of the website or breach of these terms, including related legal fees and costs.

Georgia law governs these terms. Any dispute arising from website use must be brought in a court located in Georgia.
